Terms of Service

These terms apply when you use https://gmewebdesigns.com. The specific terms of any project are set out in the written proposal or agreement we sign with you; where the two conflict, that signed agreement wins.

Using this website

You may browse and use this site for lawful purposes. Don't attempt to breach its security, scrape it at a rate that degrades service for others, submit forms with false information, or use it to distribute malware or unsolicited advertising.

Quotes and estimates

Prices published on this site are indicative starting points for typical projects. A quote becomes binding only when we've issued it in writing for your specific project and you've accepted it. Published prices can change at any time; a quote already issued to you cannot.

Payment

Monthly plans are billed in advance on the same day each month and continue until cancelled under the terms below. One-time builds are billed 50% at kickoff and 50% at launch unless the agreement says otherwise. Invoices are due on receipt. Work may be paused on accounts more than 15 days overdue.

Term and cancellation

Monthly plans run for an initial 12-month term and then continue month to month. That term exists because local SEO compounds over time and can't be fairly judged at 60 days. After the initial term either party may cancel with 30 days' written notice.

You may buy out a monthly plan at any time for the remaining balance of the equivalent one-time price, at which point the site and its code transfer to you.

Ownership

On a one-time build, ownership of the delivered website transfers to you on final payment. On a monthly plan we retain ownership of the site while the plan is active; you retain ownership of your domain, your content, your photographs and your trademarks throughout, in every case.

We keep ownership of our underlying tools, component libraries and development techniques, and may reuse them on other projects. We may also display your project in our portfolio unless you ask us in writing not to.

Your responsibilities

• Provide content, photos and feedback within a reasonable time — delays here move the launch date
• Warrant that any content you give us is yours to use and doesn't infringe anyone's rights
• Maintain access to your own domain registrar and Google Business Profile
• Ensure your business complies with the laws and licensing rules of your trade and jurisdiction

What we don't guarantee

We do not and cannot guarantee specific search rankings, traffic volumes, lead counts or revenue. Search engines control their own algorithms and change them without notice. Anyone promising you a ranking is guessing or lying. What we do commit to is the scope of work in your agreement, performed competently and on schedule.

Third-party services

The site and the services we provide rely on third parties including Vercel, Supabase, Stripe, Resend, Google and GoHighLevel. We aren't responsible for their outages, pricing changes or policy decisions, though we'll work with you to route around them.

Limitation of liability

To the fullest extent the law allows, our total liability arising out of your use of this site or our services is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, including lost profits or lost business opportunities.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in California.

Changes

We may update these terms; the date at the top will change when we do. Continuing to use the site after an update means you accept the revised terms.
